Legal help!! What to do???

My Wife and her mother are being sued by JD Byrider/CNAC an used car dealer and finance company for a car they gave back to them. I helped my wife do some research and found that they have been sued by the attorney generals office and lost. so i drafted a response to the suet, stating we should not owe the remainder of the debt and also asking for damages to be payed to the my wife and her mother. i stated a number of consumer protection laws they may have violated (Ohio Revised Code 1345), as we live in Ohio. Now there attorney called us saying they would like to drop there suet against us and fix the damage the created on my wifes credit report, as long as we sign away the right to sue them. I am not sure i we have a valid suet against them but all of the sudden the want to drop there suet if we dont file.





What should we do??? We are low income but not low enough to get legal aid. I do good research and write good papers, but cant represent my wife because im not an attorney.

Well, if you are low income and can't afford to hire an attorney but you aren't low income enough for legal aid, then it sounds like the answer is right there. Law suits cost time, money, extensive legal knowlege, and stress.





However, if your wife and her mother have a large amount of damages then they should consider getting representation by an attorney that will take it on a contingency basis. Call around and ask different attorneys if they will do that. If no attorney will take it on a contingency basis, that probably means your suit doesn't hold too much weight and you should take the deal.





It is ultimately up to you (your wife and her mother) though.
Reply:Bird in the hand is worth two in the bush in my opinion. Why risk a known victory for an unknown result? You cannot say that you will win. You are going against an experienced attorney that knows the complex rules of evidence and has greater resources for legal research than you could possibly hope to have.





Count your lucky stars that you are walking away owing nothing.
